In particular, Mr. Cunningham represents lenders and borrowers in commercial real estate financing transactions with an emphasis on multifamily and healthcare loans insured by the Federal Housing Administration and securitized through GinnieMae. In addition, Mr. Cunningham regularly advises lenders and developers on a myriad of issues related to financing, creditor rights and transactional matters.
Ben was recognized in the inaugural Best Lawyers: Ones to Watch for 2021 in the practice area of Banking and Finance Law.
Cityview Magazine has recognized Ben as a Top Attorney of Knoxville in the practice area of Banking Law in 2020.
Ben was admitted to the Tennessee Bar in 2011. He is also a member of the Knoxville Bar Association ("KBA"), Tennessee Bar Association ("TBA"), and American Bar Association ("ABA").
Ben is also a member of the Hamilton Burnett American Inn of Court, the Tennessee Valley Human Resource Association, and the Oak Ridge Human Resource Association.
Prior to joining Kennerly Montgomery in January 2014, Mr. Cunningham served as a federal prosecutor in the Eastern District of Tennessee representing the United States in a variety of civil and criminal health care related cases, including: False Claims Act cases related to procurement fraud, Stark Law violations, and cases under the Anti-Kickback Act. Mr. Cunningham’s criminal caseload focused on health care fraud and Food Drug & Cosmetic Act violations. Prior to joining the Department of Justice, Mr. Cunningham practiced at a regional defense litigation firm representing employers in the areas of labor and employment law.
Mr. Cunningham earned his Doctor of Jurisprudence cum laude from the University of Tennessee College of Law in 2011 with a concentration in advocacy and dispute resolution. Before attending law school, Mr. Cunningham earned his Bachelor of Arts degree from the University of Tennessee.
