The alternative dispute resolution group works with clients outside rather than inside a courtroom. The group has attorneys trained in two primary forms of alternative dispute resolution (ADR): mediation and arbitration. In mediation, the parties, by agreement or court order, meet with a mediator who assists to reach a mutually acceptable resolution of their disputes. Usually, mediation is non-binding, with costs paid by the parties. In arbitration, the parties, by agreement or court order, present evidence concerning their dispute to one or three arbitrators, who then decide the dispute for the parties. Arbitration is usually binding with the costs paid as agreed by the parties or ordered by the arbitrators.
Kennerly Montgomery’s alternative dispute resolution attorneys can serve as a mediator to facilitate an agreement between the parties or as an arbitrator or member of an arbitration panel to decide disputes. When not serving as a mediator or arbitrator, our members also serve as counsel to parties involved in both dispute resolution mechanisms (mediation and arbitration).
