Kennerly, Montgomery & Finley P.C.

At Kennerly Montgomery, our Landlord-Tenant lawyers specialize in representing both commercial and residential landlords for a variety of issues and disputes. We provide these services across a variety of forums including mediation, arbitration, and litigation.

Commercial Landlords

As a commercial landlord, the strength of your commercial lease is the strength of your revenue stream. You need to make sure that as a governing document, every eventuality and issue is accounted for and planned for. Without a clear definition of which party is responsible for general maintenance or larger structural issues such as plumbing or roofing, you could get mired in a dispute that sours the relationship between you and your tenants. We are here to help with that.

For our commercial clients, we handle issues including:

  • Commercial Leases
  • Liens and Collections
  • Detainers
  • Evictions

Residential Landlords

As residential landlords, preserving the property you own is of vital importance to your revenue flow. However, Tennessee has a complicated law structure around the duties of a landlord that changes based on the population of the county where the property is located. The Uniform Residential Landlord Tenant Acts (“URLTA”) only applies to counties whose population exceeds 75,000, which includes Knox, Anderson, Blount, and Sevier Counties locally. A different set of rules apply for counties not covered by the URLTA.

For our residential clients, we handle issues including:

  • Leasing Agreements
  • Collections and Damages Recovery
  • Evictions
  • Defending Fair Housing Claims
